Welcome to Christmasville in Emeryville's Santa Photoshoot Experience! We're excited to have you join us for this festive occasion. Before you proceed, please carefully read and acknowledge the terms and conditions of our liability waiver. Your safety and enjoyment are important to us, and by participating in the Santa photoshoot experience, you agree to the following terms:

Assumption of Responsibility for Safety: I acknowledge that I am personally responsible for the safety of myself, my family, my child(ren), and/or dependent(s) during the Santa photoshoot experience at Christmasville in Emeryville. I am aware that there may be inherent risks associated with participating in activities on the premises and using the facilities.

Release of Liability: With full knowledge and understanding of the risks involved, I hereby release Christmasville in Emeryville, its representatives, employees, agents, and associates, including Leah Marie Studio, from any and all liabilities, demands, claims, or actions directly or indirectly arising out of or related to any loss, damage, injury, illness, or harm sustained while participating in any activity while in, on, or around the premises of Christmasville in Emeryville or while using its facilities.

Notice of Appointment Rescheduling: I understand that if I am unable to make my scheduled appointment, I am required to provide at least a 72-hour notice to Christmasville in Emeryville. In the event that I am unable to make the appointment, I will promptly notify Christmasville in Emeryville in accordance with this notice period.

Rescheduling and Payment Transfer: I acknowledge that if I provide a minimum of 72 hours' notice for appointment rescheduling, Christmasville in Emeryville will make an effort to reschedule my appointment for a later date, subject to availability. If rescheduling is not possible, I understand that my payment for the Santa photoshoot can be applied towards a future family portrait session during the spring or fall. I am aware that refunds will not be issued in such circumstances.

No Refunds: I acknowledge that Christmasville in Emeryville does not offer refunds for the Santa photoshoot experience. If I choose to cancel my appointment without providing the required notice or fail to attend the appointment, I understand that I will forfeit any rescheduling efforts and will be liable to pay the full amount.

 

By checking the box in your intake form, you acknowledge that you have read, understood, and agreed to the terms and conditions outlined in this liability waiver. Your check is considered a virtual signature.

Please Note: Your agreement to this liability waiver is required to participate in the Santa photoshoot experience at Christmasville in Emeryville. If you do not agree to these terms, we regret to inform you that we will not be able to proceed with your booking.
